Wisc-Online offers an ever-growing library of high-quality educational teaching
materials FREE to educators. This library is kept up to date and changes as new
materials are added or existing ones are revised. All of the content for the learning
objects is the intellectual property of Wisc-Online.
Introduction
Wisc-Online and its 16 technical college partners (together referred to as the Wisc-Online
Consortium) operate this digital library and website.
Wisc-Online offers you access to the Wisc-Online Digital Library in exchange for
your agreement to accept and comply with these terms, conditions, and notices stated
here and as may be modified by Wisc-Online from time to time. Wisc-Online refers
to these terms, conditions, and notices, whether modified or unmodified, as the
"Agreement" or as the "Terms of Use."
Wisc-Online reserves the right to modify at its sole discretion this Agreement without
providing notification. You are responsible for regularly reviewing this Agreement.
By visiting or using any part of the Wisc-Online.com website, you are agreeing to
the Terms of Use, and you are agreeing that this is a binding contract between Wisc-Online
and you. If you do not wish to be bound by these terms of use, please do not visit
or use any part of the Wisc-Online website.
General Use and Limitations of General Use of the Wisc-Online.com website: Except
where we specify otherwise, Wisc-Online offers you access to the Wisc-Online.com
website solely for your personal, non-commercial, and educational uses. You promise
that you will not use the Wisc-Online.com website, logo, URL or content, in whole
or in part, for any purpose or in conjunction with any media that is pornographic,
defamatory, or otherwise unlawful or prohibited by these Terms of Use or for any
purposes other than those that are personal, non-commercial, and educational. You
agree that you will not modify, publish, license, or create derivative works from,
or transfer or sell any information, software, lists of users, databases or other
lists, products or services provided through or obtained from the Wisc-Online.com
website. This means, among other activities, that you agree not to engage in the
practices of "screen scraping," "database scraping," or any other activity with
the purpose of obtaining lists of users or other information. You agree that you
will not use the Wisc-Online.com website in any manner which could damage, disable,
overburden, or impair the Wisc-Online.com website or interfere with any other party's
use and enjoyment of the Wisc-Online.com website. You may not obtain or attempt
to obtain any materials or information through any means not intentionally made
available or provided for through the Wisc-Online.com website.

If and when requested by Wisc-Online, you agree to provide true, accurate, and complete
user information and to refrain from impersonating or falsely representing your
affiliation with any person or entity. Except with the written permission of Wisc-Online,
you agree that you will not access or attempt to access password-protected, secure,
or non-public areas of the Wisc-Online website. Unauthorized individuals attempting
to access prohibited areas of the Wisc-Online.com website may be subject to prosecution.
You agree that you will not juxtapose the Wisc-Online name and mark and the link
with your name or any other material(s) in a manner which might give rise to any
erroneous conclusion that there is any affiliation or association between Wisc-Online,
on the one hand, and you or any other person or entity, on the other hand. You agree
that if Wisc-Online, in its sole and unfettered discretion, requests in writing
that you remove any link or links to the Wisc-Online.com website, you will promptly
do so. You agree that if you create any link to the Wisc-Online.com website that
you will not employ any technology that results in the placement of content from
the Wisc-Online.com website in a frame and/or a reduced pop-up window and/or any
other display mechanism that changes the Wisc-Online.com website from how it would
appear if a user typed in its URL to a typical browser line.
Legal Notice
All materials on the Wisc-Online website are copyrighted. Educational content is
provided FREE for use by linking the materials (via copying and pasting the unique
URL for each learning object) to educational Web pages.
Privacy Statement
Wisc-Online values and takes precautions to protect the personal information users
provide us from loss, misuse, and unauthorized access, disclosure, alteration, and
destruction. Within the Wisc-Online.com website online information systems, we ask
users to provide contact information including name, educational affiliation, and
e-mail address. We store this personal information in a secure database that we
use to deliver the requested product to you.

If you contact us through our website and request information, we use the contact
information you provide only for the stated purpose. Only a limited number of authorized
employees have access to the information you provide. We will disclose your personal
information if we are required to do so by law or legal process. Your personal information

other than those described above, and will not be sold to third parties.
Viewing and Correcting Your Personal Information
You may update your personal information at any time by clicking the link labeled
My Wisc-Online on the top menu bar and selecting the Edit My Information link. Your
customized My Wisc-Online page is displayed when you log in.

There is no warranty, to the extent permitted by applicable law. Except when otherwise
stated in writing by the copyright holders and/or other parties, Wisc-Online offers
the Wisc-Online.com website "as-is" without warranty of any kind, either expressed
or implied, including, but not limited to, the implied warranties of merchantability
and fitness for a particular purpose. The entire risk of use of the Wisc-Online.com
website is with you. Should the Wisc-Online.com website prove faulty, inaccurate,
or otherwise unacceptable, you assume the cost of all necessary repair or correction.
Wisc-Online includes some health- or medical-related materials that may be considered
sexually explicit, violent, graphic, or otherwise unsuitable for younger audiences.

Purchasing Wisc-Online Products
Please read this Agreement carefully before accessing the Service. By accessing
the Service, you agree to be bound by the terms and conditions below. If you do
not wish to be bound by these terms and conditions, you may not access or use the
Service.
If you wish to make purchases of Wisc-Online products and services, you will be
asked to supply certain information, including credit card or other payment mechanism
information. You agree that all information you provide for purposes of making purchases
will be accurate, complete, and current. Wisc-Online offers downloads, translations,
training, and services. We set our own prices and may change prices or institute
new prices at any time. You agree to pay all charges incurred by users of your account
and credit card or other payment mechanism at the prices in effect when such charges
are incurred. You also will be responsible for paying any applicable taxes and shipping/handling
relating to purchases on the Service.
Single User and Organizational User Purchase/License Agreements
As stated earlier, Wisc-Online learning objects are free to view from the Wisc-Online.com
website. A Single User may also purchase a learning
object as a download or on a CD for a small fee. An Organizational
User may enter into a licensing agreement for one or more learning objects.
The definitions of Single User and Organizational User follow.
If you are an individual user or an instructor looking to use Wisc-Online learning
objects in your own classroom, with only your students, and will not be distributing
this object to other instructors, you fall under the Single User
Purchase Agreement. You may purchase learning objects as downloads or
on a CD for a small, one-time-only fee.
If you represent an organization or group of instructors seeking to purchase Wisc-Online
learning objects for use by multiple instructors and their students, or to be placed
on a server to be shared with multiple instructors and their students, you fall
under the Organizational User License Agreement. Organizational
users are required to enter into an annual license agreement with Wisc-Online for
an annual fee. Please contact the director of Wisc-Online for information.
Licenses are non-exclusive and non-transferable and may not be sublicensed. Users
may not convey or transfer an agreement or the purchased or leased learning objects.
They may not alter, crop, manipulate, or create derivative works of Wisc-Online
learning objects or content.
Wisc-Online objects may not be posted online in a manner that allows other users,
outside of the single-user and his/her students, to use or download the object.
No ownership or copyright in any learning object shall pass to the licensee or purchaser
of a learning object.

Games
GameBuilder is a software system created by Wisc-Online that allows instructors
and trainers to enter questions and answers into a game template. A variety of templates
is available.
Faculty employed by the Wisconsin Technical College System may build games at no
cost. Other interested persons may purchase an annual subscription. You may view
subscription options from the My Games section of your My Wisc-Online page. To register
as a Wisc-Online user, go to www.Wisc-Online.com. Each registered user will have
a My Wisc-Online page, hosted by Wisc-Online, to house his or her customized games
for student use.
My Account Details - Games
An annual subscription for a set number of games may be established by registered
users through credit card (Visa or MasterCard). Each registered user has a My Wisc-Online
page to use to manage customized games. Subscriptions are good for one year from
the date of purchase and are renewable and upgradable.

Failure to Comply With Terms and Conditions
Wisc-Online may deny you access to all or part of the Service without notice if
you engage in any conduct or activities that Wisc-Online at sole discretion believes
violates any of the terms and conditions in this Agreement. If Wisc-Online denies
you access to the Service because of such a violation, you shall have no right (1)
to access through Wisc-Online.com any materials stored on the Internet, (2) to obtain
any credit(s) otherwise due to you, and such credit(s) will be forfeited, (3) to
access third party services, merchandise, or information on the Internet through
Wisc-Online, and Wisc-Online shall have no responsibility to notify any third-party
providers of services, merchandise or information, nor any responsibility for any
consequences resulting from lack of notification.
You agree to defend, indemnify, and hold Wisc-Online and its member organizations
harmless from any and all liabilities, costs, and expenses, including reasonable
attorneys' fees, related to any violation of this Agreement by you or authorized
users of your account, or in connection with the use of the Service or the Internet
or the placement or transmission of any message, information, software, or other
materials on the Internet by you or authorized users of your account.
Miscellaneous
In the event that any portion of this Agreement is held to be unenforceable, the
unenforceable portion shall be construed in accordance with applicable law as nearly
as possible to reflect the original intentions of the parties, and the remainder
of the provisions shall remain in full force and effect. Wisc-Online’s failure to
insist upon or enforce strict performance of any provision of this Agreement shall
not be construed as a waiver of any provision or right. Neither the course of conduct
between parties nor trade practice shall act to modify any provision of this Agreement.
Wisc-Online may modify this Agreement from time to time by placing a notice of such
modification on Wisc-Online.com, and your continued use of the Service following
notice of such modification shall be deemed to be your acceptance of any such modification.
If you do not agree to any modification of this Agreement, you must stop using the
Service. This Agreement constitutes the entire agreement between you and Wisc-Online
with respect to the Service.
